IN ORDER TO USE THE SERVICES OFFERED ON THIS SITE, YOU ARE REQUIRED TO AGREE TO ABIDE BY THESE TERMS AND CONDITIONS. YOUR CONFIRMATION OF YOUR AGREEMENT TO THESE TERMS AND CONDITIONS IS EVIDENCED BY YOUR CONTINUED USE OF THE SITE OR YOUR REGISTRATION OF THE EVENT THROUGH THIS SITE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, THEN DO NOT REGISTER FOR THE EVENT AND CEASE USING THIS SITE. THESE TERMS AND CONDITIONS DEFINE IMPORTANT LEGAL RIGHTS AND OBLIGATIONS, PLEASE READ THEM CAREFULLY. YOU SHOULD ALSO PRINT OUT A COPY OF THESE TERMS AND CONDITIONS FOR YOUR RECORDS.

1. DEFINITIONS

The following words, when capitalized, shall have the following meanings:

\"Agreement\" shall mean these terms of service.

\"Deals Gap Rotary Rally\" or \"DGRR\" shall mean all their affiliated companies, sponsors, volunteers, organizers, and employees.

\"Deals Gap Rotary Rally Site\" shall mean the web site, including all content and services, provided through the domain name www.dealsgaprotaryrally.com.

\"Organizer\" shall mean Deals Gap Rotary Rally (DGRR) owner and organizer Philip Sohn

\"Event Operators\" shall mean Deals Gap Rotary Rally (DGRR) along with its affiliates and subsidiaries and all officers, directors, owners, agents, information providers, affiliates, employees, directors, affiliated companies.

2. REGISTERING AND ELIGIBILITY TO THE EVENT

AGE REQUIREMENT:
You must be at least eighteen (18) years of age to register for the event, Deals Gap Rotary Rally. You acknowledge and represent, covenant and agree that (i) you are at least eighteen (18) years of age, (ii) that the birth date information you shall provide in establishing your account is true, accurate, and complete, (iii) the Event Operator has the right to request proof of age information from you and (iv) that you will cooperate with the Event Operator in providing proof of your age. You acknowledge and agree that the Event Operator has the right to suspend you from the event until the Event Operator is satisfied, in the Event Operator's sole and absolute opinion, with your proof of age information.

Online registration:
Registrations are made online via Deals Gap Rotary Rally website. Once your data are filled you are registered to the event, you will be directed to the online payment.

Registration fee:
The registration fee is announced on Deals Gap Rotary Rally website. The fee to registration include access to the event, the event T-shirt, the banquet/award ceremony, use of Nantahala Village Resort. Travel and accommodation is the responsibility of the participant and is not included in the price of the event.

Registrations:
Deals Gap Rotary Rally accepts online registrations only. To register for one event, participants must fill in the corresponding registration form that can be found on the Deals Gap Rotary Rally website.

Payments:
After submitting your registration information, you will be redirected to the secured online payment system, Paypal. Payment shall be made by either credit card, bank transfer, Paypal credit, through secured Paypal website. A confirmation email will be generated with registration details.

Cancellations:
Deals Gap Rotary Rally reserves the right to defer or cancel any registration if there are insufficient registration or conditions arising beyond our control.

Cancellations by the registrant will not be accepted and registration is final.

Registrants may substitute another person by submitting a written request. Individuals are responsible for canceling their own hotel and travel reservations. Deals Gap Rotary Rally does not accept liability for hotel, travel or meal costs before and after event.

Refunds:
No refunds unless unforeseen circumstances leading to canceling of the event.

3. LIABILITY

IN CONSIDERATION of being permitted to participate in any way in this EVENT, EACH OF THE UNDERSIGNED, for themselves, personal representatives, heirs, and next of kin:

• HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE DEALS GAP ROTARY RALLY ORGANIZER FROM ALL LIABILITY TO THE UNDERSIGNED, their personal representatives, assigns heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT (S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASES OR OTHERWISE.


• HEREBY acknowledges that he/she is in good physical and mental condition, has a good driving record and is not currently taking any medication, drugs, or other substance that would impair his/her ability to drive safely. Is at least eighteen of age with a valid driver’s license.


• HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releases and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST he/she may incur arising out of or related to the EVENT(S) WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASES OR OTHERWISE.


• HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to this EVENT whether caused by the NEGLIGENCE OF RELEASES or otherwise.


• HEREBY acknowledges that THE ACTIVITIES OF THIS EVENT MAY BE DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASES.


• HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releases, INCLUDING NEGLIGENT RESCUE OPERATIONS, and is intended to be as broad and inclusive as is permitted by the laws of the Province or State in which this EVENT is conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND I HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I ALSO ACKNOWLEDGE THAT IN THE EVENT A MINOR CHILD OF MINE IS PARTICIPATING IN THIS EVENT, I AM ALSO SIGNING THIS RELEASE AS PARENT AND GUARDIAN OF SAID MINOR CHILD IN FULL ACKNOWLEDGMENT. I, ON BEHALF OF SAID MINOR CHILD, AM ABDICATING THE SAME SUBSTANTIAL RIGHTS THAT WOULD NORMALLY ACCRUE TO SAID MINOR-CHILD.
